Buyers allege home constructed by Emerald Homes was not built in accordance to standards

GALVESTON – A League City couple allege a home they purchased is uninhabitable because of mold issues.

Rick Faulkner and Lynn Faulkner filed a complaint on Aug. 21 in the Galveston County District Court against D.R. Horton - Emerald LTD, doing business as Emerald Homes, alleging negligence, breach of contract and other counts.

According to the complaint, the plaintiffs allege that on Aug. 24, 2016, they purchased a home at 2701 Veranda Falls in League City from the defendant and paid the sum of $649,000. Within a few weeks after moving in, they allege they uncovered numerous construction defects with the home, including a mold infestation that has made the residence uninhabitable.

The suit states the home the plaintiffs purchased was used as a model home and "certain shortcuts were taken in the construction of the property to insure a quick build rather than a quality product." They allege this was not disclosed to them prior to purchase.

The plaintiffs hold D.R. Horton - Emerald LTD responsible because the defendant allegedly failed to construct the residence in accordance with local, state, international and industry standards.

The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but less than $1 million and such other and further relief to which they may be entitled. They are represented by T. Ernest Freeman of The Freeman Law Firm PC in Houston.
