Consumer files suit against Direct Energy Services over telemarketing calls

SHERMAN – A Lewisville resident alleges an energy company has called her 30 times to solicit its business since she asked that it stop calling her.

Chasidy L. Hunter filed a complaint on Aug. 24 in the Sherman District of the Eastern District of Texas against Direct Energy Services LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in July, she began receiving calls to her cellular phone from the defendant soliciting her to purchase its energy services. She alleges that she did not provide consent to the defendant to contact her and instructed its representatives to stop calling her, but the defendant called an additional 30 times.

The plaintiff holds Direct Energy Services LLC responsible because the defendant allegedly made calls using an automatic telephone dialing system without her consent.

The plaintiff requests a trial by jury and seeks an order enjoining the defendant from placing any more phone calls to her cellular phone and award for damages of at least $500 per phone call and treble damages, attorney fees, costs and all other relief that are just and appropriate.
