Union Pacific Railroad employee alleges unstable ballast caused fall, fractured ankle

HOUSTON – A railroad worker alleges he sustained an ankle injury while working because of an unsafe work environment.

Quirino Villareal filed a complaint on Aug. 27 in the Harris County District Court against Union Pacific Railroad Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 20, 2015, he was in the course and scope of his employment with defendant when he was caused to fall in a rail yard due to an unstable ballast covered by water. He alleges he sustained a fractured ankle as a result.

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to properly inspect the premises, failed to properly maintain the ballast and failed to provide adequate warning.

The plaintiff seeks monetary relief of more than $1 million and such other and further relief to which he may be justly entitled. He is represented by Clint E. McGuire of Martinez & McGuire PLLC in Houston.
