HOUSTON – The spouse of a late officer with the Harris County Sheriff's Department alleges his death from a heart attack was avoidable and is seeking damages from a cardiologist and medical facility.

Carmen Carter-Faughtenbery filed a complaint on Aug. 27 in the Harris County District Court against Juan C. Rozo, MD and East Houston Specialist PLLC, doing business as Cardiology Specialist of Houston alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 10, 2017, the defendants assumed care of her spouse, Terry Faughtenbery, for cardiac problems. The plaintiff alleges an EKG was ordered by Rozo and that Rozo prescribed medication to Terry Faughtenbery, told him to track his blood pressure and to schedule an echocardiogram and treadmill stress test in the future.

The suit states Terry Faughtenbery, an officer with the Harris County Sheriff's Department, was found dead in his parked and running patrol vehicle on Feb. 13, 2017. His cause of death was myocardial infarction, or heart attack, the suit states.

The plaintiff alleges that the defendants were negligent in their care in treating Terry Faughtenbery and that his death was avoidable.

The plaintiff seeks monetary relief of no less than $1 million and such other and further relief to which she may be justly entitled. She is represented by Tim Riley of Riley Law Firm in Houston.
