HOUSTON – A Waller consumer alleges he has been harassed with calls by a debt collector over an alleged debt he disputes.
Joshua McCafferty filed a complaint on Aug. 30 in the Houston Division of the Southern District of Texas against I.C. System Inc. alleging that the debt collector violated the Fair Debt Collection Practices Act and the Texas Debt Collection Act.
According to the complaint, the plaintiff alleges that in early 2018, he began receiving calls to his cellular phone from defendant attempting to collect an alleged debt from Verizon, which the plaintiff disputes. He alleges he asked the defendant to stop calling him, but the calls have continued.
The plaintiff holds I.C. System Inc. responsible because the defendant allegedly continuously called him after he demanded that it stop calling, failed to provide validation of the alleged debt and threatened him to take legal action against him if he did not pay the subject debt.
The plaintiff requests a trial by jury and seeks actual damages, statutory damages of $1,000, costs and attorney fees and such other and further relief as this court deems just and appropriate.
