HOUSTON – A consumer alleges a debt collector has harassed her by calling on numerous occasions.
Kimberly A. Mulharan filed a complaint on Aug. 30 in the Houston Division of the Southern District of Texas against Credence Resource Management LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in June, she began receiving collection calls to her cellular phone from defendant attempting to collect an alleged debt. She alleges she asked the defendant to stop calling her but it has called her 20 times since making that request.
The plaintiff holds Credence Resource Management LLC responsible because the defendant allegedly contacted her without her permission and made calls using an automated telephone dialing system.
The plaintiff requests a trial by jury and seeks actual and punitive damages, costs and reasonable attorney fees and such other and further relief as court deems just and proper.
