Misdiagnosis of eye patient's condition subject of med-mal case

BEAUMONT – Local attorney Malachi Daws of The Daws Law Firm recently filed a medical malpractice lawsuit against an ophthalmology practice and an eye specialist on behalf of a woman who claims a misdiagnosis and a botched procedure left her permanently legally blind and with a droopy eye in one eye.

In the 12-page suit filed late last month in Jefferson County District Court, Ozge Gunaydin-Sen states that Dr. Burt A. Ginsberg, who is employed by Retina Vitreous Associates, incorrectly diagnosed her with retinoschisis, an eye disease characterized by the abnormal splitting of the retina's neurosensory layers.

Court papers assert that Ginsberg failed to properly treat Gunaydin-Sen despite her complaints about continuous pain and loss of vision in her left eye. Seeking a second opinion, the plaintiff visited another ophthalmologist who “ultimately” recommended surgery to remove a cataract and repair the retina.

The original petition faults the defendants’ “negligent” treatment for rendering her legally blind in her left eye, adding the eye is “significantly disfigured and shows signs of exotropia with a distorted pupil.”

Consequently, the complainant seeks unspecified monetary damages and a jury trial.
