SHERMAN – A Plano man alleges he was terminated from his employment because of his disability, race and religion.
Lamar D. Williams filed a complaint on Sept. 10 in the Sherman District of the Eastern District of Texas against Lattimore Materials Co. citing the Americans with Disabilities Act and Title VII of the Civil Rights Act of 1964.
According to the complaint, the plaintiff began his employment with the defendant in 2013. The suit states in January, he slipped and fell during work and filed a workers' compensation claim. The suit states on March 18, he was released to work full duty.
On March 20, the suit states he was terminated from his employment as a mixer driver for alleged insubordination.
The plaintiff holds Lattimore Materials Co. responsible because the defendant allegedly failed to make reasonable accommodations for his disability and retaliated against him by terminating his employment for filing a charge of discrimination with the Equal Employment Opportunity Commission on March 16. He also alleges his African-American race and religion, Yahushua Speaks Worldwide Assembly, were factors in his termination and discrimination from the defendant.
The plaintiff requests a trial by jury and seeks compensatory damages, reinstatement to his former position, attorney’s fees, costs and interest and such other and further relief, both legal and equitable. He is represented by John E. Wall Jr. of Law Offices of John E. Wall Jr. in Dallas.
