NIE Insurance alleged to have failed to pay for Harvey-caused roof damage at Baytown property

HOUSTON – The owner of a dry cleaning business alleges that the roof was damaged by Hurricane Harvey and her insurer has failed to pay for repairs.

Victoria Le filed a complaint on Sept. 12 in the Harris County District Court against NIE Insurance and Joshua Flores alleging breach of contract and fraud.

According to the complaint, the plaintiff alleges that in 2017, her insured property at 3911 Garth Road in Baytown was damaged by Hurricane Harvey. She alleges the defendants have refused to pay to repairs necessary to fix the damage to the roof, which has caused further water damage to the property.

The plaintiff holds NIE Insurance and Flores responsible because the defendants allegedly breached the contract by failing to make payments outlined in the contract.

The plaintiff requests a trial by jury and seeks all damages, plus interest, costs and such other and further relief to which she may be entitled. She is represented by S. Greg Rushing of The Rushing Law Firm in Houston.
