TEXARKANA – A debt collector is allegedly harassing a consumer with collection calls.
Keith A. Campbell filed a complaint on Sept. 25 in the Texarkana Division of the Eastern District of Texas against Total Account Specialty Collections alleging that the debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff defaulted on a medical debt in 2008 and the statute of limitations expired on it in 2012. The suit states in 2015, the defendant began calling the plaintiff in an attempt to collect the debt and the plaintiff asked it to stop calling in April 2017. He alleges the defendant continues to call.
The plaintiff holds Total Account Specialty Collections responsible because the defendant allegedly completely disregarded his request stop calling him and continued to incessantly call him, using both live agents and prerecorded messages.
The plaintiff requests a trial by jury and seeks actual and punitive damages, attorney fees and such other relief that is just and appropriate. He is represented by Marwan R. Daher and Omar T. Sulaiman of Sulaiman Law Group LTD in Lombard, Illinois.
