The DeLoney Law Group alleged to have sent unlawful collection letter to Bonham consumers

SHERMAN – Two Bonham consumers are seeking damages from a debt collector over allegations a letter it sent them is unlawful.

Robert and Jennifer Walton filed a complaint on Sept. 27 in the Sherman District of the Eastern District of Texas against The DeLoney Law Group PLLC alleging that the debt collector violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiffs allege that on Nov. 24, 2017, they received communication letters from defendant with respect to an alleged debt from Sparks Regional Medical Center. They allege the letter fails to explain the relationship between their rights to dispute the debt and the defendant's threat of litigation.

The plaintiffs also allege that the defendant failed to indicate in the letter that there was no attorney involvement in the debt collection process.

The plaintiffs request a trial by jury and seek actual damages, statutory damages of $1,000, attorney's fees, costs and interest and such other and further relief deemed just and proper. They are represented by Russell S. Thompson IV of Thompson Consumer Law Group PLLC in Mesa, Arizona.
