Driver seeks $1 million from businesses over accident with intoxicated motorcycle rider

GALVESTON – One million dollars is being sought from two entities from a man who alleges his leg was amputated because of injuries sustained in an accident with an intoxicated motorcycle rider.

Jarrell Bryant filed a complaint on Sept. 28 in the Galveston County District Court against A&D Interest Inc., doing business as Heartbreakers/The Club; Jackie's Brickhouse, et al. alleging that they violated the Dram Shop Act.

According to the complaint, the plaintiff alleges that on Oct. 1, 2016, defendants' patron, Eric McDougle, was unable to safely ride his motorcycle due to intoxication and caused an accident with plaintiff. The plaintiff alleges suffered injuries that resulted in leg amputation as a result of the collision. 

The plaintiff holds A&D Interest Inc., doing business as the Heartbreakers/The Club, et al. responsible because the defendants allegedly negligently sold, served and/or provided alcoholic beverage to McDougle even though he was obviously intoxicated.

The plaintiff seeks monetary relief of more than $1 million and such other and further relief to which he may be entitled. He is represented by David J. Romagosa of Farrar & Ball LLP in Houston.
