HOUSTON – The mother of a man who was killed earlier this year in a motor vehicle accident in New Mexico while transporting ammunition has pursued legal action, recent Harris County District Court records show.
Marletha Jackson filed a lawsuit against Devon Energy Corp.; Agility Energy, Inc. and others on behalf of the estate of Malachi Jackson in the Harris County 333rd District Court on Sept. 28.
Court documents explain that the decedent had been working nearly 18 hours per day as of last Mar. 13 when Devon directed him to drive to Carlsbad, N.M. to dispose of ammunition that had been found in his vehicle.
According to the original petition, a commercial motor vehicle operated by Agility collided with the younger Jackson just as he was returning from Carlsbad. He died as a result of the accident, the suit says.
It asserts that the decedent was “overworked” at the time of the subject event.
Consequently, his mother seeks unspecified monetary damages and a jury trial.
