Woman trips over hole at gas station, sues business

HOUSTON – A woman’s trip and fall at a north Houston gas station has resulted in litigation, according to recent Harris County District Court records.

Benicisa Mouton filed a lawsuit against Love’s Travel Stops & Country Stores, Inc. and Love’s Travel Stops on Oct. 4 in the Harris County 61st District Court in response to the incident earlier this year at the defendants’ business located at 3940 N. McCarty St.

Court documents pin the event in question on an uncovered fuel reservoir. An employee of the defendants “failed to put the cover back on the hole,” the original petition states.

Mouton, in turn, explains that “her attention and focus was on making sure she did not get hit by traffic, including 18-wheelers.”

“She did not believe that such defects would be created by the defendant, requiring her to stare at the ground, instead of traffic,” the suit says.

Consequently, the complainant seeks unspecified monetary damages.

She is represented by the law firm Mestemaker & Straub in Houston.
