International Construction Equipment accused of disability discrimination

HOUSTON — A sales representative is suing International Construction Equipment Inc., citing alleged disability discrimination and wrongful termination.

Ricardo Garcia filed a complaint on Oct. 3, in the Houston Division of the Southern District of Texas, against International Construction Equipment Inc. alleging that the employer violated the Americans with Disability Act and the Texas Labor Code.

Garcia alleges that on Jan. 5, 2017, he was fired from his employment despite increasing sales while he was recovering from an injury, as he still continued to call on customers while recovering. 

The plaintiff holds International Construction Equipment Inc. responsible because the defendant allegedly subjected him to negative job actions based on his disability.

The plaintiff requests a trial by jury and seeks all damages, plus interest, reinstatement with seniority, litigation costs and expenses and any other relief deemed just and proper.
