HOUSTON — A worker is suing Polyone Corp., after allegedly falling down a staircase.
Raul Saldana filed a complaint on Oct. 4, in the Harris County District Court, against Polyone Corp., alleging that the premises occupier failed to maintain complete control of its premises.
According to the complaint, the plaintiff alleges that on Feb. 24, he was working for his employer installing machinery on the second floor of the defendant's building.
While descending the stairs, he allegedly fell from a height of eight feet. He suffered numerous and serious injuries, resulting in medical expenses, pain and suffering, mental anguish and lost wages.
The plaintiff holds Polyone Corp. responsible because the defendant allegedly failed to reinstall the handrail of the stairwell and failed to give adequate warning of existing danger.
The plaintiff requests a trial by jury and seeks monetary relief of less than $100,000 and further relief to which he is entitled.
He is represented by David K. Mestemaker, Norman Straub, Jonathan B. Zumwalt and Codi K. Kraus of Mestemaker & Straub in Houston.
