Consumer alleges Kemper withdrew $810 from bank account without signing contract

HOUSTON – A Harris County consumer alleges an insurance company wrongfully withdrew money from her bank account without a contract.

Vickie Davis filed a complaint on Oct. 10 in the Houston Division of the Southern District of Texas against Credit Collection Services Inc., Kemper Corp. and SelectQuote Auto and Home Services LLC alleging violation of the Fair Debt Collection Practices Act and the Texas Debt Collection Act.

According to the complaint, the plaintiff requested insurance quotes online in a survey and was contacted by SelectQuote with the option to purchase home and auto insurance through Kemper. The suit states she later chose to purchase insurance through State Farm and did not sign a contract with Kemper. The suit states Kemper withdrew $810.10 from her checking account in May.

In September, the suit states the plaintiff received a collection letter in the mail from Credit Collection Services regarding an alleged debt owed to Kemper.

The plaintiff holds Credit Collection Services Inc., Kemper Corp. and SelectQuote Auto and Home Services LLC responsible because Credit Collection Services allegedly used false or misleading representations to collect a debt; Kemper allegedly misrepresented its ability to collect premium payments without a contract; and SelectQuote allegedly wrongfully disclosed her bank information to Kemper.

The plaintiff requests a trial by jury and seeks actual damages, costs, attorney fees and any other relief deemed just and appropriate. She is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
