Kemah man alleged to have breached settlement agreement with Houston resident

GALVESTON – A Houston resident alleges a Kemah man failed to pay a settlement agreement.

Bin Xu filed a complaint on Oct. 15 in the Galveston County District Court against Robert Trost alleging breach of contract

According to the complaint, the plaintiff previously sued the defendant for allegedly breaching a construction agreement. The suit states on Feb. 9, 2017, the parties entered into settlement agreement that involved payment of $12,000 by the defendant to plaintiff.

The plaintiff holds Trost responsible because the defendant allegedly breached the agreement in February and has remained in default.

The plaintiff seeks monetary relief of $100,000 or less, including damages of any kind, penalties, costs, expenses, prejudgment interest and attorney fees. The plaintiff is represented by Lawrence F. Cerf of Lawrence F. Cerf, Attorney at Law in Houston.
