Two allegedly injured in Galveston crash with dump truck seek $1 million from truck's driver

GALVESTON – Two Scurry residents allege a Hitchcock dump truck driver failed to keep a proper lookout before colliding with their vehicle in Galveston.

Crystal Barton and Emily Donaldson filed a complaint on Oct. 12 in the Galveston County District Court against Kenneth Sealy, doing business as Kenny's Trucking, alleging negligence.

According to the complaint, the plaintiffs allege that on July 17, they were travelling northbound in or near the 2700 block of 61st Street in Galveston when suddenly and without warning, defendant's dump truck collided with the rear of their vehicle. The suit states the collision caused the plaintiffs' vehicle to be pushed into the vehicle in front of them. They allege they sustained severe injuries and incurred medical care and expenses, pain and suffering, mental anguish and loss of earning capacity as a result of the collision. 

The plaintiffs holds Sealy responsible because the defendant allegedly failed to keep a proper lookout, failed to apply brakes in a timely and prudent manner and failed to maintain a safe distance.

The plaintiffs request a trial by jury and seek monetary relief of more than $1 million and such other and further relief to which they may be entitled at law or in equity. They are represented by Ryan H. Zehl, Matt L. Martin and W. Lamar DeLong of Zehl & Associates PC in Houston.
