Former administrator alleges Altus Bayton Hospital terminated her in retaliation

HOUSTON – A woman alleges she was terminated in retaliation from her position as a hospital administrator because of her disability and reporting of an alleged violation.

Elizabeth Hardy filed a complaint on Oct. 17 in the Houston Division of the Southern District of Texas against Oprex Surgery LP, doing business as Altus Bayton Hospital; and ZT Wealth LLC, doing business as ZT Corporate, citing the Family Medical Leave Act and the Americans with Disabilities Act.

According to the complaint, the plaintiff was hired by the defendants in March 2016 as director of quality. The suit states in September 2016, she was diagnosed with a degenerative joint disease in her hip and underwent a procedure in November 2016 and another in May 2017.

The suit states she took FMLA leave in November 2017 for a total hip replacement and reported an alleged Health Insurance Portability and Accountability Act violation in April against the chief nursing officer. The suit states she was terminated in May.

The plaintiff holds Oprex Surgery LP and ZT Wealth LLC responsible because the defendants allegedly failed to accommodate her disability and terminated her for reporting alleged violations of rules and regulations.

The plaintiff requests a trial by jury and seeks all damages, with interest, attorney’s fees, costs, reinstatement of lost fringe benefits or seniority rights and such other and further relief to which the she may be entitled.
