JE Dunn Construction, driver sued over fatal Highway 290 crash

HOUSTON – Two Louisiana residents allege the failure of a Deer Park driver to operate his employer's vehicle safely caused a fatal collision.

Patricia Ledet and Tammy Couch filed a complaint on Oct. 18 in the Houston Division of the Southern District of Texas against JE Dunn Construction Co. and John Robert Benson III alleging negligence and other counts.

According to the complaint, the plaintiffs allege that on Nov. 28, 2017, the plaintiffs' decedent Leonard Hagans' vehicle was struck by defendant Benson, who was traveling at an extremely high rate of speed on Highway 290 in Waller County. The suit states Hagans later died of his injuries.

The suit states Benson was traveling 82 mph in a 65 mph zone while operating a vehicle owned by his employer, JE Dunn.

The plaintiffs hold JE Dunn Construction Co. and Benson III responsible because defendant Benson failed to control his speed, failed to observe and follow traffic laws and failed to operate his vehicle in a safe and careful manner.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount to be determined by the trier of fact and all further relief as the court deems just and proper. They are represented by Anthony G. Buzbee and Ryan S. Pigg of The Buzbee Law Firm in Houston.
