Pedestrian seeks more than $200,000 from Texas City residents over alleged dog attack

GALVESTON – A pedestrian alleges she was attacked and bitten by a dog owned by a Texas City couple.

Shantanna Miles filed a complaint on Oct. 22 in the Galveston County District Court against Audelina Olivo Duarte and Ignacio Duarte alleging strict liability and negligence.

According to the complaint, the plaintiff alleges that on Aug. 8, she was walking to work past the defendants' home in Texas City when she was attacked and bitten by defendants' dog. She alleges she sustained injuries resulting in medical expenses, pain and mental anguish, physical impairment, disfigurement and lost wages as a result. 

The plaintiff holds Audelina Olivo Duarte and Ignacio Duarte responsible because the defendants allegedly failed to tie up the dog so it could not attack individuals and failed to get rid of the dog once they knew it had the propensity to bite.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other and further relief to which she may show himself justly entitled. She is represented by John Arthur Daspit of Daspit Law Firm in Houston.
