Safe Way Auto Glass member seeks refund of $20,000 contribution

HOUSTON – A Harris County woman is seeking a refund of the money she invested in a business.

Golrokh Malakan filed a complaint on Oct. 26 in the Harris County District Court against Safe Way Auto Glass LLC and Bita Abadi alleging fraud.

According to the complaint, the plaintiff and Abadi founded Safe Way Auto Glass in February. The plaintiff alleges she borrowed $20,000 funds to invest in Safe Way Auto Glass in exchange for 25 percent ownership of the business plus 25 percent in future profits.

She alleges Abadi refused to share in the company's profits or disclose any financial information. In June, the suit states her attorney contacted Safe Way for a refund of her contribution in exchange for her withdrawal as a member. The suit states Abadi has refused the requests.

The plaintiff holds Safe Way Auto Glass LLC and Abadi responsible because the defendant Abadi allegedly made false representations to her.

The plaintiff requests a trial by jury and seeks writ of mandamus compelling defendants to allow her access to the books and records for inspection, monetary relief of more than $100,000 and such other and further relief to which she is entitled.
