GALVESTON – A Brazoria County consumer alleges a debt collector continued to call after she asked it to stop.
Nadeane N. Haynesworth filed a complaint on Oct. 29 in the Galveston Division of the Southern District of Texas against Noram Debt Management LLC, also known as Noram Capital Holdings Inc., alleging violation of the Texas Debt Collection Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that due to financial hardship, she fell behind on her regular payments to Cashnet for a loan with the unpaid balance of $950. Around the summer of 2018, the suit states she began receiving calls to her cellular phone from the defendant attempting to collect upon the alleged debt.
The suit states the plaintiff asked the defendant to cease calling her, but it has called 15 times since she made the request. She also alleges the defendant unlawfully threatened imprisonment if she did not pay the alleged debt.
The plaintiff holds Noram Debt Management LLC responsible because the defendant allegedly used an automatic telephone dialing system to contact her without her consent in violation of the TCPA, invaded her privacy, and violated the TDCA by calling her after she asked it to stop.
The plaintiff requests a trial by jury and seeks actual damages, attorney fees, costs and any other relief as this court deems just and appropriate. She is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
