Consumer alleges Choice Home Warranty invaded privacy with calls

HOUSTON – A Muldoon consumer alleges a New Jersey company invaded her privacy with telemarketing calls.

Judy Foster filed a complaint on Oct. 30 in the Houston Division of the Southern District of Texas against CHW Group Inc., doing business as Choice Home Warranty, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges beginning in June, the defendant began calling her cellular telephone for telemarketing purposes. She alleges she never gave the defendant permission to call her.

The plaintiff holds CHW Group Inc. responsible because despite her request to stop calling her on her cellular telephone, the defendant allegedly refused to do so and continued to make calls using an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each and every violation and treble damages of $1,500 for each and every willful violation of the TCPA and any other relief deemed appropriate. She is represented by Michael S. Agruss of Agruss Law Firm LLC in Chicago.
