HOUSTON – A Harris County man alleges he was improperly fitted for dentures and suffered unnecessary pain.

Toby Landry filed a complaint on Oct. 31 in the Harris County District Court against Dr. Blake Lindsey, DDS and Heath Bryan Coleman of Texas DDS PLLC, doing business as DDS Dentures & Implant Solutions of Katy, alleging negligence.

According to the complaint, the plaintiff saw the defendants in 2016 for complete implants and permanent dentures. He alleges he was fitted for one set of permanent dentures that were lost during shipping, and the second set of dentures were improperly seated and fit incorrectly. He alleges he requested his medical records and demanded a refund for the unfinished work so he could have another dentist complete the procedure. He alleges he received his records Aug. 8, 145 days after his initial request.

The plaintiff holds Lindsey and Heath Bryan Coleman of Texas DDS PLLC responsible because the defendants allegedly failed to properly take the impression for the second permanent denture, failed to properly fit it, and failed to diagnose complications of the denture.

The plaintiff seeks actual and punitive damages, costs of court, interest and all other relief to which he is entitled. He is represented by Caroline C. Batten and Carl R. Dawson of Ryan & Dawson in Houston.
