State district judge approves nonsuit of legal malpractice case against divorce attorney

HOUSTON – A two-month-old legal malpractice lawsuit against a local divorce attorney was recently nonsuited, per Harris County District Court records.

Harris County 334th District Judge Steven Kirkland issued an order approving Zahira Alcover’s notice of voluntary nonsuit on Oct. 22.

As previously reported in The Southeast Texas Record, Alcover sued Bobby K. Newman of the law firm Lilly, Newman & Van Ness LLP in Houston and his practice in late August. Alcover accused the defendants of failing to produce a Real Estate Lien Note and Deed of Trust in accordance to a decree issued in her favor.

Court records show that the respondents did not formally respond to Alcover’s allegations.
