HOUSTON – A Canyon man alleges his former Katy and Lubbock employers only paid him straight time for overtime work.
Luke Kallenbach filed a complaint on Nov. 2 in the Houston Division of the Southern District of Texas against Mewbourne Oil Co. and Turnco Enterprises LLC alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff was employed by the defendants from February 2017 to October as a flowback operator. He alleges he worked in excess of 40 hours in a week but was never paid any overtime premium for his work in excess of 40 hours.
The plaintiff holds Mewbourne Oil Co. and Turnco Enterprises LLC responsible because the defendants allegedly treated him as an independent contractor and did not compensate him at a rate of one-and-one-half times his regular rate of pay for each hour worked in excess of 40 in a workweek.
The plaintiff requests a trial by jury and seeks damages for unpaid wages, liquidated damages, attorney’s fee and costs and such other relief as the court may find proper.
