Driver seeks damages from employer, Aldi after falling at freight dock

HOUSTON – A delivery driver alleges he was injured while inside a freight dock at a Houston grocery store.

Rosendo Rosales filed a complaint on Nov. 5 in the Harris County District Court against Aldi Inc. and Titus Holdings LLC alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Nov. 27, 2016, he was employed by defendant Titus and was making a delivery to defendant Aldi's Highway 6 South, Houston premises when he slipped and fell on a liquid substance. He alleges he sustained personal injuries resulting in pain and suffering, mental anguish, loss of earnings and medical expenses as a result. 

The plaintiff holds Aldi Inc. and Titus Holdings LLC responsible because defendant Aldi failed to timely inspect the premises to discover any dangerous condition, failed to remove or clean the liquid substance and failed to give adequate warning about it and Titus allegedly failed to provide training and implement proper safety protocols/procedures.

The plaintiff seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may be justly entitled. He is represented by Ronald T. McLain of The McLain Law Group in Houston.
