Seaman alleges he was injured aboard Lady Geneva, seeks more than $1 million in damages

HOUSTON – A Jones Act seaman is seeking $1 million from his Palacios employer over alleged injuries he sustained while aboard a vessel.

Jimmy Diaz filed a complaint on Nov. 9 in the Harris County District Court against Joe A. Perez Jr., individually and doing business as Lady Geneva, alleging negligence.

According to the complaint, the plaintiff alleges that in October, he was injured while working as a seaman aboard the Lady Geneva. He alleges he sustained serious and debilitating injuries to his knee, thigh, lower leg and other parts of the body when a piece of metal scratched and punctured his skin. 

The plaintiff holds Perez, individually and doing business as Lady Geneva, responsible because the defendant allegedly failed to inspect, maintain and/or repair the vessel's equipment; failed to provide safety equipment; and failed to provide adequate medical treatment to him.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million. He is represented by John D. Sheppard, Nicholas A. Morrow and Daniel Sheppard of Morrow & Sheppard LLP in Houston.
