Tenant sues apartment complex, claims security personnel assaulted him

HOUSTON – A local man is suing his apartment complex on allegations it failed to prevent him from being assaulted by its security personnel two years ago.

Danny Rutherford’s lawsuit against Broadway Village Apartments, LLC; Apt Broadway Village, LLC; and Marshall Security, which was filed on Nov. 11 in the Harris County 113th District Court, says the incident occurred at the conclusion of a birthday party the plaintiff held for his wife on the night of Nov. 12, 2016.

Rutherford explains that he was in the process of taking down his setup for the celebration ahead of the complex’s midnight outdoor music curfew when officers employed by Marshall arrested him and forcibly threw him to the ground.

According to the suit, the property failed to properly force the time and restriction guidelines.

Consequently, Rutherford seeks unspecified monetary damages and a jury trial.

He is represented by Eric L. Rhodes of The Rhodes Law Firm, P.C. in Houston.
