Man fights shoplifting accusation with lawsuit

HOUSTON – A local man alleges in a state district lawsuit that a home improvement retail company wrongfully accused him of shoplifting.

Recent Harris County District Court records show that William Davis filed the suit against Lowe’s Home Center, LLC on Nov. 13 in the 333rd District Court.

The original petition explains that the business implicated Davis in the alleged theft of a $119 Black and Decker trimmer from its store at 1000 Gulfgate Center Mall on Nov. 27, 2016. According to the plaintiff, Lowe’s misidentified him since his driver’s license was stolen before the date in question.

Davis adds that he attempted to get the theft charges dismissed on numerous occasions, claiming he “has lost sleep worrying about other people suspecting that he is a thief.”

Consequently, the plaintiff seeks unspecified monetary damages.

He is represented by Philip J. Orth, III of Channelview.
