HOUSTON – A railroad worker alleges he was injured when a transportation service driver fell asleep at the wheel and crashed the vehicle into a fence.

Trevor Wright filed a complaint on Nov. 12 in the Harris County District Court against Union Pacific Railroad Co. and Railcrew Xpress LLC alleging negligence and other counts.

According to the complaint, the plaintiff was employed by Union Pacific as a conductor and was in a bus being transported by Railcrew Xpress' driver when the driver fell asleep and crashed the vehicle into a chain link fence. The plaintiff alleges he was injured as a result.

The plaintiff holds Union Pacific Railroad Co. and Railcrew Xpress LLC responsible because the defendants allegedly failed to promulgate and enforce safety policies and procedures and failed to properly hire, train and supervise personnel.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other and further relief to which he may be justly entitled. He is represented by Anthony G. Buzbee, Andrew Dao and Cornelia Brandfield-Harvey of The Buzbee Law Firm in Houston and Michael Herzik of the Herzik Law Firm in Houston.
