Worker files suit against P.C. Pfeiffer, others over accident with forklift

BEAUMONT – A Jefferson County man alleges an on-the-job accident led to the amputation of his foot.

David W. Mickles filed a complaint on Oct. 29 in the Jefferson County District Court against P.C. Pfeiffer Co. Inc., et al. alleging gross negligence and premises liability.

According to the complaint, the plaintiff alleges that on Sept. 18, he was employed by James J. Flanagan Shipping Corp., which was subcontracted by P.C. Pfeiffer Co. The suit states on that date, he was operating a 12,000 pound pneumatic tire forklift when it began rocking due to excessive weight of the load, causing the machine to fall and land on him. The plaintiff alleges his foot was nearly severed at the ankle, which required amputation, and he sustained injuries to his left arm. 

The plaintiff holds P.C. Pfeiffer Co. Inc., et al. responsible because the defendants allegedly failed to provide adequate equipment and failed to provide sufficient training and supervision.

The plaintiff seeks monetary relief and such other and further relief to which he is entitled. He is represented by Muhammad S. Aziz of Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston and Allena J. Wright of Law Office of Allena J. Wright in Houston.
