Kellermeyer Bergensons Services, GI KBS Parent alleged to have failed to pay overtime

HOUSTON – An integrated retail property services company is alleged to have failed to pay an assistant custodian the correct rate for overtime pay.

Jorge Aguilar filed a complaint on Nov. 19 in the Houston Division of the Southern District of Texas against Kellermeyer Bergensons Services LLC and GI KBS Parent Corp. alleging violation the overtime provision of the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendant for six years as an assistant custodian. He alleges that he regularly worked more than 40 hours each week but was paid the same hourly rate regardless of the number of hours he worked.

The plaintiff holds Kellermeyer Bergensons Services LLC and GI KBS Parent Corp. responsible because the defendants allegedly failed to pay wages at a rate of time-and-one-half of his hourly rate for all hours worked in excess of 40 per workweek.

The plaintiff requests a trial by jury and seeks unpaid overtime compensation, liquidated damages, interest, attorneys’ fees, costs and expenses and such other and further relief as may be allowed by law. He is represented by Mark Siurek of Warren & Siurek LLP in Houston.
