TEXARKANA – A Bowie County consumer alleges a debt collector has called her multiple times to collect a debt owed by another unknown party.

Gwenevere J. Bennett filed a complaint on Nov. 28 in the U.S. District Court for the Eastern District of Texas Texarkana Division against CBE Cos. Inc., doing business as CBE Group, alleging that the third-party debt collection agency violated the Fair Debt Collection Practices Act and the Texas Debt Collection Act.

According to the complaint, the plaintiff alleges that around the fall of 2018, plaintiff began receiving calls to her cellular phone from the defendant attempting to collect upon a debt owed by an individual with whom she was unfamiliar. She alleges she informed the defendant it was contacting the wrong party and asked it to stop calling her. She alleges she still receives phone calls from the defendant.

The plaintiff holds CBE Cos. Inc. responsible because despite her request to cease contacting her as well as being told that the individual it was contacting was unknown, the defendant allegedly continued to contact her without her consent.

The plaintiff requests a trial by jury and seeks actual and punitive damages, attorney fees, costs and any other relief deemed just and appropriate. She is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
