HOUSTON – A forklift operator alleges he was injured while unloading a tractor-trailer when the driver drove forward, causing the forklift to fall.
Pascal Aguilar Curiel filed a complaint on Nov. 30 in the Harris County District Court against Sarbali Alloys LLC, Sarbali Inc. and Juan Santiesteban alleging negligence.
According to the complaint, the plaintiff alleges that on Oct. 3, 2017, he was operating a forklift unloading parts from a tractor-trailer for Sarbali Alloys. He alleges he was injured when defendant Santiesteban drove the tractor-trailer forward, causing the forklift to fall from the loading ramp.
The plaintiff holds Sarbali Alloys LLC, Sarbali Inc. and Santiesteban responsible because defendant Santiesteban carelessly moved the tractor-trailer without any warning, failed to keep a proper lookout and failed to keep the vehicle under proper control.
The plaintiff seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may be justly entitled. He is represented by Nomaan Husain of Husain Law + Associates PC in Houston.
