Consumers allege Mobility Lift Aids disclosed false information about minivan before purchase

HOUSTON – A Tennessee couple alleges the Houston sellers of a minivan misrepresented the condition of the vehicle.

Jerry Harmon and Norma Harmon filed a complaint on Dec. 4 in the Harris County District Court against Mobility Lift Aids LLC, et al. alleging that they violated the Texas Deceptive Trade Practices Act.

According to the complaint, the plaintiffs allege that on Oct. 18, based on defendants' promises and assurances, they agreed to purchase a 2006 Buick Terraza for $17,145 that had a handicap conversion package. They allege the defendants represented to them that the vehicle had no visible signs of rust.

The plaintiffs allege after purchasing the vehicle, they took it to a mechanic and learned that due to severe rust on the vehicle, it was unsafe to drive and unrepairable.

The plaintiffs hold Mobility Lift Aids LLC, et al. responsible because the defendants allegedly breached the contract with them by disclosing false information about the vehicle.

The plaintiffs request a trial by jury and seek rescission of the contract, attorney's fees, costs and such other and further relief as may be just and proper. They are represented by Dana Karni and Zachary McArthur of Karni Law Firm PC in Houston.
