Texcap Financial allegedly continued to call Houston man after he asked it to stop

HOUSTON – A Houston consumer alleges a debt collector trying to collect a debt owed by a family member ignored his requests to stop contacting him.

Michael D. Jackson filed a complaint on Dec. 10 in the Houston Division of the Southern District of Texas against Texcap Financial LLC alleging violation of the Telephone Consumer Protection Act and the Texas Debt Collection Act.

According to the complaint, the plaintiff alleges that in around fall of 2018, he began receiving calls to his cellphone from the defendant seeking to collect on a debt incurred by his son. He alleges he told the defendant that he does not owe the debt and asked that it stop calling him.

The plaintiff holds Texcap Financial LLC responsible because despite his demand to stop calling him, the defendant allegedly continued to regularly call his cellphone up until the filing of this suit.

The plaintiff requests a trial by jury and seeks actual and punitive damages, costs, attorney fees and such other just and appropriate relief. He is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
