Andalucia Nuts alleges it is owed for more than 4,000 cases of peanut butter

HOUSTON – A wholesale producer and manufacturer of peanut butter alleges it was not paid for more than 4,000 cases of peanut butter.

Great Host International Inc., doing business as Andalucia Nuts, filed a complaint on Dec. 20 in the Harris County District Court against JK Snacks LLC and James O. Kane alleging breach of contract, fraud and quantum meruit.

According to the complaint, the plaintiff was engaged by the defendants to manufacture peanut butter for the defendants' customer, the Texas Department of Criminal Justice. The plaintiff alleges that on Aug. 23, 2018, it shipped a total of 4,200 cases of peanut butter to TDCJ. 

The plaintiff holds JK Snacks LLC and Kane responsible because the defendants allegedly failed to pay for the peanut butter pursuant to the purchase order. The plaintiff alleges it suffered damages of $59,129.

The plaintiff seeks actual, special, economic and compensatory damages; court costs, interest and other relief the court deems just. It is represented by Haroon Rafati of The Rafati Law Firm PLLC in Katy.
