Insured driver alleges USAA Insurance breached contract when it refused to pay benefits

HOUSTON – A Harris County man alleges he was injured in a motor vehicle accident and his insurance company refused to pay benefits due to him.

Rudolph White filed a complaint on Dec. 20 in the Harris County District Court against USAA Insurance alleging unfair settlement practices, breach of contract and other counts.

According to the complaint, the plaintiff alleges that on April 17, 2017, he was injured in an auto collision due to the carelessness of an underinsured driver. He alleges he sustained injuries to his neck and back and subsequently notified defendant of the accident to seek payment for the benefits under the underinsured motorist provision of the policy. 

The plaintiff holds USAA Insurance responsible because the defendant allegedly failed and reused to pay the benefits due to plaintiff pursuant to the policy and refused to pay without conducting a reasonable investigation.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 and all other relief to which plaintiff may be justly entitled. He is represented by Todd E. Webb of The Law Office of Todd E. Webb in Houston.
