Injured employee alleges workers' comp claim was factor in termination from Onin Staffing, Merchants Metals

HOUSTON – A Houston man alleges he lost his job at a fence system manufacturing company after he injured his elbow while working.

Curtis Trulock filed a complaint on Dec. 26 in the Harris County District Court against Onin Staffing LLC and Merchants Metals LLC alleging that they violated the Texas Workers' Compensation Act.

According to the complaint, the plaintiff alleges that on June 22, 2018, he dislocated his right elbow while working for the defendants at Merchants Metals. He alleges when he tried to return to work on June 25, 2018, he was told he couldn't return to work at Merchants Metals and that Onin Staffing notified him that he would not be placed at another job.

The plaintiff holds Onin Staffing LLC and Merchants Metals LLC responsible because the defendants allegedly retaliated against him by terminating his employment for filing a workers' compensation claim.

The plaintiff seeks compensatory and punitive damages, costs of court and such other and further relief to which he may be justly entitled. He is represented by David J. Manley in Houston.
