Enterprise Rent-A-Car seeks $100,000 from lessee over auto accident

GALVESTON – A car rental company is suing a Texas City resident for damages after the rental vehicle was involved in an accident.

Enterprise Rent-A-Car filed a complaint on Dec. 28 in the Galveston County District Court against Amikka Cunningham alleging breach of contract and negligence.

According to the complaint, the plaintiff alleges the defendant rented a vehicle from it in December 2014. The suit states on Feb. 9, 2015, the defendant negligently operated plaintiff's vehicle and struck another vehicle, an object or both and damaged the vehicle. The plaintiff alleges the defendant failed to pay for the amounts owed.

The plaintiff holds Cunningham responsible because the defendant also allegedly failed to yield to the right of way and failed to obey a traffic control device.

The plaintiff seeks monetary relief of $100,000 or less. It is represented by Thomas H. Scott and Kimberly B. Scott of Basham & Scott in Houston.
