SHERMAN – A Plano man alleges he was terminated from his job as a managing director for a Dallas office and his age was a factor.

Daryl R. Hebert filed a complaint on Dec. 31 in the Sherman District of the Eastern District of Texas against Unum Group, doing business as Unum Group Corp., et al. alleging violation of the Age Discrimination in Employment Act and Title VII of the Civil Rights Act.

According to the complaint, the plaintiff alleges on March 5, 2018, he was terminated from his employment with the defendants after his 31-year tenure with Unum. He was 61 at the time of this termination and alleges his age and sex were factors in the matter.

The plaintiff holds Unum Group, et al. responsible because the defendants allegedly subjected him to adverse employment actions, intentionally discriminated against him because of his age and sex, retaliated against him by terminating him for engaging in a protected activity and replaced him with an employee 20 years younger than him.

The plaintiff requests a trial by jury and seeks all damages, reinstatement to a comparable position with benefits, and award for all damages, plus interest, attorney’s fees, costs and such other and further relief to which he may be justly entitled. He is represented by Robert G. Chadwick Jr. of Seltzer, Chadwick, Soefje & Ladik in Frisco.
