All American Orthopedic and Sports Medicine Institute patient alleges vein was injured during surgery

HOUSTON – A patient alleges an injury to a vein during a shoulder surgery required further surgery and treatment.

Joyce Phillips filed a complaint on Jan. 7 in the Harris County District Court against Marston S. Holt MD, Marston Shaun Holt MD PA and All American Orthopedic and Sports Medicine Institute PLLC alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 12, 2017, she underwent a partial shoulder replacement surgery performed by Holt. The suit states that during the surgery, there was an injury to the axillary vein and Holt repaired the injury.

The plaintiff alleges on Jan. 23, 2017, she was diagnosed with a venous clot and needed surgery and physical therapy.

The plaintiff holds the defendants responsible because the Holt allegedly failed to obtain a vascular surgeon consult and failed to promptly diagnose and treat the injury.

The plaintiff requests a trial by jury and seeks all damages, with interest, costs and such other and further relief to which she may be justly entitled. She is represented by Tommy R. Hastings and Gregory L. Feste of Hastings Law Firm PC in The Woodlands.
