Invitee alleges leaky vent at 24 Hour Fitness facility caused fall

HOUSTON – A Harris County man alleges he was injured at a Houston gym because of water on the floor from a HVAC vent.

Mustansir Abbas filed a complaint on Jan. 10 in the Harris County District Court against 24 Hour Fitness USA alleging premises liability.

According to the complaint, the plaintiff alleges that on July 15, 2017, he was a business invitee at defendant's fitness center facility in Houston when he slipped and fell on a wet floor. The plaintiff alleges he believes the water was leaking from an HVAC vent in the ceiling and that the issue had been reported multiple times.

The plaintiff holds 24 Hour Fitness USA responsible because the defendant allegedly failed to maintain the area in a safe manner and warn of the condition.

The plaintiff seeks actual and special damages, costs, expenses and interest and such other and further relief, legal or equitable to which he is justly entitled. He is represented by David K. Mestemaker, Norman Straub and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
