Harris County doctor allegedly failed to timely refer patient to specialist for arthritis diagnosis

HOUSTON – A former patient of a Harris County physician alleges her condition was misdiagnosed.

Victoria Peloubet filed a complaint on Jan. 18 in the Harris County District Court against Dr. Lynn Gibbs alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 12, 2010, she consulted defendant due to symptoms of rheumatoid arthritis. She alleges the defendant incorrectly diagnosed her with degenerative arthritis in April 2014, and made the correct diagnosis in November 2014. The plaintiff alleges the defendant finally agreed to refer to her a specialist in March 2016, but failed to complete the appropriate paperwork.

The plaintiff alleges she ended her relationship with the defendant in June 2017 and was finally able to see a specialist the following month after her symptoms had severely progressed.

The plaintiff holds Gibbs responsible because the defendant allegedly failed to timely refer her to an appropriate specialist for proper treatment and failed to treat her with appropriate medication.

The plaintiff requests a trial by jury and seeks damages in an amount within the jurisdictional limits of the court, with interest, costs, attorney's fees and such other and further relief to which she may be justly entitled. She is represented by Angela Spears and Marian S. Rosen of Rosen & Spears in Houston.
