Patient files suit against physician, Choice Family Medicine over care

HOUSTON – A Harris County man alleges a doctor failed to ensure a cardiology consultation was performed prior to his discharge from a hospital.

Randy Diggs filed a complaint on Jan. 30 in the Harris County District Court against Amer Zaheer MD and Choice Family Medicine alleging negligence and other counts.

According to the complaint, the plaintiff went to the St. Luke's emergency department on March 21, 2018, with complaints of chest pain and shortness of breath. The suit states he was discharged by Zaheer, an employee of Choice Family Medicine, two days later with a diagnosis of constipation. The plaintiff alleges he went to the emergency department again on March 29, 2018, and underwent a coronary artery bypass grafting and mitral valve replacement on April 4, 2018.

The plaintiff holds Zaheer and Choice Family Medicine responsible because Zaheer allegedly failed to ensure an order for a formal cardiology consultation was performed prior to his discharge.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may show himself justly entitled. He is represented by Steven R. Davis and John A. Davis Jr. of Davis & Davis, Attorneys at Law in Houston.
