Fecal matter in the pool, 24 Hour Fitness sued for man's 'severe' bacterial infection

HOUSTON – Claiming that he contracted a severe bacterial infection as a result of a poorly maintained public swimming pool at a local 24 Hour Fitness facility, Texas resident Albert Guerra has filed a state district lawsuit against the California-based exercise-oriented chain.

According to Guerra’s suit, he was using the defendant’s fitness pool on Dec. 31, 2017 when another member immediately advised him “to evacuate the pool as there was fecal matter contained at the bottom of the pool.”

Guerra was reportedly hospitalized for several days afterwards.

Consequently, he seeks unspecified monetary damages and a jury trial.
