Customer accuses Sprint employee of 'maliciously' resetting his smartphone, misrepresenting herself as a technician

HOUSTON – A Harris County man has taken Sprint and one of its employees to court, claiming the defendants intentionally deleted the data from his smartphone.

David Jones filed a lawsuit against Sprint Communications Co., L.P. and Sabrina Ortega on Feb. 25 in the Harris County 270th District Court.

The 10-page original petition explains that Jones went to the Sprint Store located at 10255 North Fwy. in Houston earlier this month to seek assistance in locating a file containing pictures on his Samsung S5 device. Ortega reportedly presented herself as a technician and worked on Jones’s phone.

The plaintiff then discovered that the reset the employee defendant supposedly performed was actually her erasing all the information that was previously stored on the device and the SIM card.

He also learned from another worker that Ortega was not a technician as she initially claimed, the suit says.

Court documents further state that Jones took his phone to an authorized Samsung dealer inside of a Best Buy and was able to recover “approximately” 30 percent of his data.

According to the plaintiff, he does not know why Ortega “maliciously” reset his device.

Consequently, Jones seeks unspecified monetary damages.

He is representing himself.
